The Labuan business activities are guided by the Act and guideline issued by Labuan Financial Services Authority (www.labuanfsa.gov.my). The Labuan Companies Act provides for the incorporation, registration and administration of Labuan and foreign Labuan companies in Labuan. The incorporation of a Labuan Company or registration of a foreign Labuan Company requires appointment of a Labuan Trust Company who will act as agent for the applicant. The Labuan Trust Company will provide the registered office address for the incorporated Labuan Company.
Labuan provides the set up, establishment, regulation and dissolution of foundations under Labuan Foundations Act. Unlike the Trust, it is an independent self-governing legal entity. It is not an "obligation” as with a Trust, but a completely legal entity.The recognition for the creation of Trust in Labuan is governed by the Labuan Trusts Act.The establishment, regulation and dissolution of limited partnerships and limited liability partnerships are governed by the Labuan Limited Partnerships & Limited Liability Partnerships Act.
The financial conventional activities in Labuan cover the activities of banking, insurance, trust or private trust company, manage trust, fund management, money broking and leasing business are governed by the Comprehensive Act Labuan Financial Services and Securities Act 2010 (LFSSA) Whilst the Labuan Islamic Financial Services and Securities Act 2010 (LIFSSA) covers the Islamic governance activities inclusive of Islamic Trust and Islamic Foundations.
Labuan also sets out the parameters relating to the establishment and operation of the Labuan International Commodity Trading Company under Global Incentives for Trading Programme. It is a framework of incentives for traders of specified commodities to use Malaysia as their international trading base to undertake international commodity trading business in Labuan IBFC;
